- Marriage refers to the social and legal bond between spouses. Throughout American history, access to marriage has been regulated and expanded based on different categories of race, gender, and sexuality. Individual rights within marriage have expanded and contracted, such as the individual legal autonomy of spouses, immigration and citizenship status, and access to reproductive health care. Examples of the ebb and flow of marriage rights in the U.S. include the Expatriation Act (1907) which revoked the American citizenship of women who married non-citizens; Loving v. Virginia (1965) which removed the ban on interracial marriage; and Obergefell v. Hodges (2015) which overturned the ban on same-sex marriage.
