- Defendant's rights refers to legal rules and constitutional protections for the due process rights of criminal defendants. The courts have continued to define these rights more explicitly at a state and federal level to include the requirement of a criminal suspect being read their rights upon arrest (Miranda v. Arizona), the right to an attorney (guaranteed by the 6th Amendment and expanded under Gideon v. Wainwright), and the right to bodily autonomy within the legal system (Winston v. Lee).
