I Daniel Freeman of Gage County Nebraska Territory do herby apply to enter under the Provisions of the Act of Congress approved May 20th 1862 entitled, an Act to Secure Homesteads to Actual Settlers on the Public Domain the south half of NW 1/4 & NE 1/4 of NW 1/4 & SW 1/4 of NE 1/4 Sec. 26. in Township Four (4) N. in Range Five East, containing 166 acres, having filed my Preemption Declaration thereto on the eighth day of September 1862.

Proof Required Under Homestead Acts May 20, 1862, and June 21, 1866.
We, Joseph Graff and Samuel Kilpatrick do solemnly swear that we have known Daniel Freeman for over five years last past; that he is the head of a family consisting of wife and two children and is a citizen of the United States; that he is an inhabitant of the S½ of NW¼ & NE[¼] of NW¼ and SW¼ of NE¼ of section No. 26 in Township No. 4 N of Range No. 5 E and that no other person resided upon the said land entitled to the right of Homestead or Pre-emption.
That the said Daniel Freeman entered upon and made settlement on said land on the 1st day of January, 1863, and has built a house thereon part log & part frame 14 by 20 feet one story, with two doors, two windows, shingle roof, board floors and is a comfortable house to live in and has lived in the said house and made it his exclusive home from the 1st day of January, 1863, to the present time, and that he has since said settlement ploughed, fenced, and cultivated about 35 acres of said land, and has made the following improvements thereon, to wit: built a stable, a sheep shed 100 feet long, corn crib, and has 40 apple and about 400 peach trees set out.

It is hereby certified, That pursuant to the provisions of the act of Congress, approved May 20, 1862, entitled "An act to secure homesteads to actual settlers on the public domain,"
Daniel Freeman has made payment in full for S½ of NW¼ and NE¼ of NW¼ and SW¼ of NE¼ of Section Twenty Six (26) in Township four (4) N of Range five (5) E containing 160 acres.
Now, therefore, be it known, That on presentation of this Certificate to the Commissioner of the General Land Office, the said Daniel Freeman shall be entitled to a Patent for the Tract of Land above described.

- The Homestead Act allowed any citizen or intended citizen to claim and settle 160 acres of federal land. In exchange for a filing fee and the completion of five years of continuous residence and cultivation of the land, settlers would receive ownership of the land. This act incited further westward expansion and dispossession of Native lands. One of the first land claims for a homestead was filed by Daniel Freeman in Gage County, Nebraska Territory. After initiating his claim on January 1, 1863, and providing proof of his continued residence and cultivation, he received ownership of the land on January 20, 1868.
